As you may know by now, the Supreme Court did not make known its decision on the Affordable Care Act today, instead creating an additional “decision day” for the term on Thursday. That is when the decision will come down. The wizards at SCOTUSblog have inferred that the opinion is being written by the Chief Justice, possibly with the assistance of Justice Kennedy. That is the scenario, if I am not mistaken, most consistent with the expectation that the decision will be a limited invalidation of ACA, perhaps just involving the individual mandate.
